The most common type of family law case is divorce, as divorce can only be obtained in court. Just as you have to go to the registrar to get married, dissolution requires an appearance before an official body.
When divorcing, the parties must agree on a number of issues if there are children, known as ancillary issues. These include the settlement of parental custody, the parent’s contact with the child, the award of maintenance and the use of the home. If there is no dispute between the parties about the divorce and they can agree on the ancillary issues, they can reach an agreement that leads to a simple, quick and cost-effective divorce. In the same agreement, it is also possible to agree on property issues.
Under the current rules, divorce and matrimonial property disputes can be dealt with in two separate actions. a property suit is only necessary if there is no agreement between the parties.
In family law cases, it is very important to know that it is possible to ask for a modifying of previous decisions if circumstances change, e.g. an increase in alimony, a change of contact are very common types of cases.
